Unauthorised use at the former Doctor’s Surgery, Stroud Ave – Update

Planning Officers have used their delegated powers to refuse planning permission to convert the former Doctor’s Surgery in Stroud Avenue to multiple occupation.

The application was retrospective as the building has been in multiple occupation since the early part of last year. When this was picked up by the council the owners put in a planning application to normalise the use. This was refused. A further application was submitted which has subsequently been refused.

The unauthorised use was discussed at Planning Committee back in the autumn where Willenhall Lib Dem Cllr Ian Shires succeeded in getting support for enforcement action to be taken against the owners. “We will be checking up on progress of that enforcement action as it was supposed to be running consecutively with the determination of the retrospective planning application.” said Ian.

The refusal of planning permission is good news for local residents however people need to be vigilant as the applicants could still take their case to appeal by the Secretary of State. If this were the case it could turn out very costly for them if they were unsuccessful as planners do not refuse applications unless they feel confident that their ruling would stand up at appeal.
